The Mathematical Foundations of Law

In order to continue living as free society, where privacy and trust allows that the exercise of liberties may also cause harm through immaturity or indecency, we must contemplate two things:

  • When legislation and judiciary enforcement should rightfully limit the practice of one’s natural liberty, and
  • when such person can be identified to have the capacity to act without such limitations of freedom

We acknowledge the natural state for humans and a humane society entails the rights enshrined in our constitution. Such society requires a defense of the higher order - meaning the ideals of life, in absentia the failings we seek to outgrow. The defense of a free society ensures its continuation.

where privacy and trust allows

Privacy is the state given to a person such that they have sovereignty over their person and self-development. As unique as we were made, beyond the common struggles we face in fraternity or sorority, so unique the conditions that uplift us. Trust stands as the belief that each person has the will and willpower to follow our code of rights I such way that neither infringes the rights of others. The establishment of trust demands conduct that individuals and their peers agree does suitably portray the character of a person.

We understand that information, like any tool, has no inherent right or wrong, good or evil - rather a person can choose to do right or wrong.

through immaturity or indecency,

The will of a person to choose right or wrong comes from whether they have learned these rights and the responsibilities that constitutional right gives uniformly to self and peer.

we must contemplate two things:

Preserving these constitutional rights means preservation for both, two things limitless self-development, and limitless development of the societal accord. These two foundations have distinct needs yet are interdependent. The practice of a health society demands a healthy and sympathetic balance of these foundations.

Since we trust individuals to act in right accord via their sovereign privacy, we need first only consider ramifications that arise from the breach of this trust. When a person’s conduct infringes upon another’s right to conduct themselves within their rights, then they do disservice to the constitution of our society. In such circumstances it becomes necessary to limit the actions of such individuals who limit the growth and liberty of others.

when such person can be identified to have the capacity to act without such limitations of freedom

All individuals, including those who wrongly infringe upon the rights of others, have a natural desire to live free to the level of each potential - including that have had a right suspended within the society. To the ends of each and all, the suspension of any right may only come with the definition for the reversing the suspension. Necessitating the definition for reversal shall ensure that laws and judgements are commutative, in addition to following by the traditional foundations of distributive and associative. This builds upon our existing foundation of law, to ensure that all restrictions of rights shall exist as commutative. The individual retains right to commute the position they’ve created.
